The owner and operator of the MEApp Application (hereinafter: Application) is the University of Miskolc (registered office: 3515 Miskolc, Egyetemváros; tax number: 19253055-2-05; institutional identifier: FI87515) (hereinafter: Operator).

I. USER

These Terms and Conditions set forth the rules upon the acceptance of which the user of the Application (hereinafter: User) may use the Application. A prerequisite for downloading and using the Application is that the User accepts the regulations set out in this document as binding upon themselves.

By downloading the application from the Google Play and Apple App Store webstores, the User acknowledges that they have familiarized themselves with the content of these Terms and Conditions and declares that they accept its provisions as binding upon themselves.

The User is obliged to use the Application lawfully and to refrain from disrupting the operation of the Application.

II. PURPOSE OF THE APPLICATION

The purposes of the Application are the following:

• to facilitate student life at the University of Miskolc and to provide students with fresh and up-to-date information;
• to provide information regarding the operation of the University of Miskolc;
• to publish educational, research, and service-related information;
• to provide data of public interest and data public on grounds of public interest;
• to provide information services related to the performance of the public duties of the University of Miskolc.

III. USE OF THE APPLICATION

The Application can be downloaded free of charge from the Google Play and Apple App Store webstores. The authorised use of the Application is also governed by the webstore provider’s End-User License Agreement (EULA) in force at any given time, which is made accessible by the provider. In the event of any conflict between a provision of these Terms and Conditions and a provision of the End-User License Agreement, the relevant provision of these Terms and Conditions shall prevail.

The User is obliged to use the Application in a lawful manner and in accordance with its intended purpose. It is prohibited, among other things:

• to distribute malicious code; to disrupt or deny service;
• to engage in unauthorized access, reverse engineering, or the circumvention of security solutions;
• to perform automated data collection (scraping);
• to infringe upon the personal rights and intellectual property rights of others;
• to publish unlawful or misleading content.

The Operator is entitled to restrict non-compliant use, or to suspend or terminate access.

IV. RIGHT TO UNILATERAL AMENDMENT

The Operator is entitled to unilaterally amend these Terms and Conditions at any time – subject to prior notice to the Users –, to supplement them with new conditions, or to delete certain conditions. In the event of a change to these Terms and Conditions, the continued use of the Application by the User shall constitute automatic acceptance of the amendments. If any change of any nature occurs in the Terms and Conditions, the Operator shall send a notification to the User through the Application.

V. LIABILITY

The information published in the Application is for informational purposes only. The Operator shall make every effort to ensure that the information contained in the Application is up-to-date, accurate, and reflects reality; however, the Operator makes no warranties, either express or implied, regarding the information provided through this Application, and reserves the right to make changes and corrections at any time without notice, or to terminate the Application or the information published therein, in whole or in part.

The Operator assumes no liability for any inaccuracies or omissions occurring in the Application.

Any decision based on the information found in the Application is the sole responsibility of the User.

The Operator assumes no liability for any loss or damage arising from the access to, the lack of access to, or the use of the Application or any information contained therein.

The Operator shall not be held liable for any potential damages, losses, or expenses arising from the use of the Application, their unusable state, improper operation, malfunction, or the unauthorized alteration of data by any person, as well as those stemming from delays in information transmission, mobile viruses, line or system failures, or other similar causes. Exceptional to this provision are cases where the information or content available in the Application contains incorrect or misleading data in a manner attributable to the Operator or due to the Operator’s negligence, and the Operator has failed to make every effort to rectify it.

Some of the links available in the Application point to websites operated by third parties or launch third-party applications. The Operator has no authority to review these contents provided by third parties; therefore, the Operator cannot be held liable for such contents. The Operator makes no warranties regarding the accuracy, currency, suitability, or quality of the information appearing in such contents, nor for any objectionable, inaccurate, misleading, or unlawful content made available by third parties.

VI. COPYRIGHT

The Application, along with all visual, audio, and textual content contained therein, as well as their arrangement, are protected by copyright. Any use thereof – to an extent exceeding personal use – in any form is permissible subject exclusively to the express, written permission of the Operator to that effect.

The Operator consents to the User downloading the Application onto their mobile phone free of charge, thereby acquiring a one-time right of use for the Application; however, this does not include the right of reproduction, distribution, or adaptation.

Please be advised that any use that deviates from or violates the Operator’s conditions detailed above may entail copyright, civil, and criminal law consequences. The Operator shall take action against any infringement that comes to its attention.

The User acknowledges that if they make any idea, development proposal, or any other comment available to the Operator, the Operator may utilize it, and the User shall not be entitled to any remuneration and/or copyright protection for doing so.

VII. DATA PROTECTION, PERMISSION REQUESTS, AND SETTINGS

The details of data processing are contained in the Privacy Policy (https://www.uni-miskolc.hu/mobilapp/adatvedelmi-nyilatkozat/).

The personal data required for authenticated functions originate from the Operator’s systems via the shadow DB. The Application uses these data for identification, authorisation checks, and personalization.

Location data: GPS-based navigation and proximity notifications require location access; the Application provides clear information regarding the purpose and processing of this access, which may be revoked on the device at any time.

Notifications: Use of in-app and push notifications; push notifications are enabled by default, and the topics can be customized within the application.

User settings: Specifying areas of interest for targeted notifications; marking favorites for locations, events, and discounts.

VIII. APPLICABLE LAW, JURISDICTION

With respect to matters not regulated in these Terms and Conditions, the provisions of the Hungarian legislation in force at any given time – in particular, Act V of 2013 on the Civil Code – and the regulations of the Hungarian authorities shall apply without further stipulation.

In the event of a legal dispute arising between the User and the Operator in connection with the use of the application, the Parties stipulate the jurisdiction of the Hungarian courts and the application of Hungarian substantive and procedural laws.
